These Terms and Conditions (“Terms”) govern the provision of inspection services by Forscher Property Inspections (“we”, “us”, “our”) and apply to all clients (“you”, “your”) who engage our services or use our website www.forscherpropertyinspections.com (the “Website”).

By requesting a quote, booking an inspection, accepting a report, making payment, or otherwise instructing us to provide services, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not proceed with our services.

These Terms should be read together with our Privacy Policy and Cookie Policy.

1. About Forscher Property Inspections

Forscher Property Inspections is a professional property inspection company providing residential and commercial inspection services. Our services include, but are not limited to:

  • Standard Home Inspections
  • 4-Point Inspections (insurance and major systems)
  • Wind Mitigation Inspections
  • Pre-Listing Inspections
  • Commercial Property Inspections
  • Pool & Spa Inspections
  • Mold Inspections
  • Leakage Inspections
  • Building Inspections
  • New Construction Inspections

All services are provided in accordance with applicable standards of practice, regulations, and industry best practices.

2. Definitions and Interpretation

In these Terms:

“Client” means the individual, company, or organisation instructing Forscher Property Inspections.

“Inspection” means the visual, non-invasive examination of a property or system.

“Report” means the written inspection report issued following an Inspection.

“Property” means the building, structure, or site being inspected

“Services” means the inspection services agreed at the time of booking

Headings are for convenience only and do not affect interpretation. Words in the singular include the plural and vice versa.

3. Scope of Services

3.1 Nature of Inspections

All Inspections are visual and non-invasive unless expressly stated otherwise. We do not move furniture, lift flooring, dismantle systems, or perform destructive testing.

3.2 Limitations

Our Services are limited to the scope agreed at the time of booking and the systems and components that are visible and reasonably accessible at the time of Inspection.

We do not guarantee the identification of every defect, hazard, or code violation.

3.3 Exclusions

Unless explicitly included, our Services do not cover:

  • Engineering analysis
  • Code compliance certification
  • Asbestos testing or removal
  • Invasive testing or concealed conditions
  • Future performance of systems

4. Client Responsibilities

You agree to:

  • Provide accurate and complete information
  • Ensure safe and reasonable access to the Property
  • Ensure utilities are connected and operational where required
  • Inform us of known hazards or restrictions
  • Obtain permission to access the Property where necessary

Failure to meet these responsibilities may limit the Inspection or affect the accuracy of the Report.

5. Booking, Fees, and Payment

5.1 Bookings

Bookings are confirmed once agreed in writing or electronically.

5.2 Fees

Fees are quoted based on the information provided and the type of Inspection requested.

5.3 Payment Terms

Payment is due as agreed at the time of booking and may be required before the Report is released.

5.4 Late Payment

Late or non-payment may result in delayed delivery of Reports or additional charges.

6. Cancellations and Rescheduling

6.1 Client Cancellations

Cancellations or rescheduling requests must be made within the timeframes specified at the time of booking. Late cancellations may incur fees.

6.2 Our Right to Reschedule

We reserve the right to reschedule Inspections due to weather, access issues, safety concerns, or unforeseen circumstances.

7. Inspection Reports

7.1 Purpose of Reports

Reports are prepared solely for the Client for the specific purpose of evaluating the condition of the Property at the time of Inspection.

7.2 Third-Party Reliance

Reports may not be relied upon by third parties without our prior written consent.

7.3 Time-Sensitive Nature

Reports reflect conditions observed on the date of Inspection only and do not represent future conditions.

8. Mould, Environmental, and Specialised Inspections

Environmental and specialised inspections, including mould or leakage inspections, are limited in scope and do not guarantee the absence of contaminants or moisture issues.

Laboratory analysis, where applicable, is performed by third-party laboratories, and we are not responsible for their results.

9. New Construction Inspections

New construction or phase inspections are limited to observable conditions at the time of Inspection and do not replace municipal inspections or warranties provided by builders.

10. Commercial Property Inspections

Commercial inspections are conducted in accordance with the agreed scope and do not constitute a full building survey unless expressly stated.

11. Limitation of Liability

To the fullest extent permitted by law:

  • Our total liability shall not exceed the fee paid for the specific Inspection giving rise to the claim
  • We are not liable for indirect, incidental, or consequential damages
  • Nothing in these Terms limits liability for death or personal injury caused by negligence or fraud.

12. Indemnity

You agree to indemnify us against claims arising from misuse of Reports, inaccurate information provided by you, or unauthorised reliance by third parties.

13. Complaints and Dispute Resolution

Any concerns or complaints should be raised promptly so we may attempt to resolve them.

14. Force Majeure

We shall not be liable for failure or delay caused by events beyond our reasonable control, including severe weather, natural disasters, or access restrictions.

15. Data Protection

We process personal data in accordance with our Privacy Policy and applicable data protection laws.

16. Website Use

Website content is provided for general information only. We do not guarantee the accuracy or availability of content.

17. Governing Law and Jurisdiction

These Terms are governed by the laws of the applicable jurisdiction in which services are provided. Any disputes shall be subject to the exclusive jurisdiction of the relevant courts.
